본 연구는 바이오뱅크를 사용하고 있는 의과학 연구자들이 실질적으로 어떤 어려움을 겪고 있는지를 규명하여 그 전망을 제시하고자 하였다. 그 결과, 대부분의 연구자들은 다양하고 모호한 법적·윤리적 갈등을 경험하면서도 충분한 설명에 근거한 동의(informed consent) 원칙을 지키고 있었다. 기존의 바이오뱅크 정의에 비추어볼 때, 바이오뱅크는 본연의 역할을 충분히 다하지 못하였고, 대부분의 연구자들은 충분한 설명에 근거한 동의 원칙의 엄격한 적용으로 인해 운영상 어려움을 겪고 있었다. 특히 의과학 연구자들에게 연구자간·국가간 자료공유 및 사용은 다른 어떤 것보다 중요한 이슈로 인식되었다. 한편 자료 제공자에 대한 혜택분배 여부에 대해서는 찬성과 반대 입장이 공존하였다.
This study aims to identify the principal issues and prospects of biobank management based on a survey of 13 researchers. The survey was conducted in October 2012 using questionnaires with open-ended questions. The main results are as follows: Most respondents followed a procedure of informed consent despite experiencing various (often ambiguous) legal and ethical difficulties. Domestic biobanks are not satisfied with the definition of “biobank” proposed by the existing research. Broad consent was considered indispensable if it could be complementary to the principles of informed consent. Data sharing among researchers or countries was perceived to be one of the most important aspects of biobank management. It was similar to numbers between the support and the opposite of distribution of benefits to donors. The institutionalization of biobanks was left as a task to be worked out in the future. For a biobank to be successful, it is necessary to establish a clear policy direction and to make concrete efforts (reorganization of the biobank system, implementation of broad consent, social discussion of benefit sharing, and efforts for reducing researchers’ legal and ethical conflicts). Policies must be prepared using institutional strategies on the basis of public consensus and trust among citizens, researchers, and the government. Finally, it is necessary for researchers to recognize the social, legal, and ethical implications of biobank management by setting up an integrative channel to inform researchers of important issues regarding biobank policies. |
