현행 특허법의 해석에 따르면 의료방법발명은 산업상 이용 가능성이 없으므로 특허가 되지 못한다. 이 글은 동 발명을 영업비밀로 보호할 수 있는지에 대하여 외국의 사례와 국내적 필요성을 검토하였다. 이와 관련하여 유럽, 일본에서는 관련 자료가 없는 실정이나, 미국에서는 의료방법발명도 영업비밀이 될 수 있음을 전제로 공방을 펼친 판례가 파악되었다. 영업비밀의 정의에 근거하여도 의료방법 발명은 충분히 영업비밀의 보호대상이 될 수 있다. 즉, 의료방법발명이 경제성, 비공지성, 비밀관리성이라는 영업비밀의 세 요건을 충분히 충족할 수 있는 것이다. 그 외, 이 글은 헌법적 견지, 산업정책적 견지에서도 의료방법발명을 영업비밀로서 보호하는 것이 필요하고 나아가 바람직하다고 본다. 발명가 또는 과학기술자의 권리를 보호할 필요는 의료계에서도 동일하게 적용되어야 한다. 의료산업이 국가성장동력이 될 수 있음에 주목하여 새로운 의료방법을 개발하는 발명가에게 인센티브를 제공할 필요가 있다. 그러한 검토에 근거하여, 이 글은 부정경쟁방지 및 영업비밀보호법 제2조 제2호를 개정하여‘의료방법’이 영업비밀의 한 종류임을 명확하게 하여야 한다고 보았다. 나아가, 의료방법발명의 발명가를 제대로 보호하기 위해서는 의료방법이 특허법에 의해서도 보호되어야 한다고 주장한다. 다만, 의료방법발명의 특수성을 감안하여 해당 특허권에 대한 일정한 제한은 필요할 것이다.
According to current interpretation of the patent law, medical method inventions cannot be patented due to lack of industrial applicability. This paper, under the purpose to protect medical method inventions at least under the trade secret law, researched relevant foreign precedents and domestic necessity. Regarding this issue, in Germany and Japan, there have been no direct discussions, in the U.S.A., there have been some cases where debates are based that medical method inventions can be protected by trade secret law. Further under the definition of trade secret, medical method inventions can clearly be subject matter of the trade secret protection. In other words, medical method inventions can clearly comply with three requirements of trade secret, i.e., economicality, secrecy and secrecy maintenance. Furthermore, this paper proclaims that it is necessary and advisory to protect medical method inventions as trade secret under Constitutional aspect and industry-policy aspect. The necessity to protect rights of inventors, scientists or engineers must be similarly applied to medical fields. Paying attention on the fact that the medical industry can be a national development driving force, we better endow necessary incentives to inventors who invents new medical methods. Based on such reviews, this paper proposes to amend Article 2(2) of the Trade Secret Act, to make it clear that medical method is one type of trade secret. Additionally, this paper claims that, to protect medical method inventors more strongly, medical method inventions be protected by patent law. In doing so however, considering special aspects of medical method inventions, certain limitations on the patent right could be applied.
