환자의 프라이버시 및 정보보호의 법적 근거 고찰/Analysis of Legal Basis Regarding Patient Privacy and Protection of Information

개인정보의 보호의 문제는 프라이버시 보호 또는 사생활의 보호라는 헌법적 가치의 실현과 관련된 문제라고 할 수 있다. 그러나 현대사회에서 개인정보의 수집과 보관 및 활용이 전산화?대량화됨에 따라 개인정보의 유출의 피해사례가 증가하고 있다. 개인정보 중에서도 특히 환자의 진료정보 또는 건강정보는 매우 민감한 정보에 속하며, 그 만큼 높은 수준의 개인정보 보호조치가 필요하다고 할 것이다. 환자의 프라이버시와 정보보호를 위한 법적 근거로서 개인정보보호에 관한 일반법으로서 「개인정보보호법」을 들 수 있는 바, 동법은 개인정보보호에 관한 일반원칙을 제시하고, 개인 정보의 수집, 활용 및 파기라는 단계적 처리절차를 규율하고 있다. 한편, 개정 생명윤리법은 개인정보를 이용한 연구를 ‘인간대상연구’로 규정하고 동법의 적용대상으로 하고 있다. 본 논문에서는 개인정보보호법과 생명윤리법을 중심으로 환자의 프라이버시 및 정보보호에 관한 법적 근거를 살펴보고, 위 법률을 적용함에 있어 나타날 수 있는 법적 문제에 대한 시사점을 제공하고자 한다. 

• Abstract

Protection of personal information or privacy is the problem of the realization of the Constitutional values. In modern society, the collection, storage and utilization of personal information has been computerized, and the damage of personal information exposure is increasing. Medical information or health information is especially sensitive information. The author reviews the kinds of Korean statutes regarding the protection and regulation of patient privacy and personal information. 「Personal Information Protection Act」 and 「Bioethics and Safety Act」 are main statutes designed to regulate the protection of the privacy and information. Under Korean law system, Personal Information Protection Act is the common rule relating to the protection of personal information. The Act regulates the general principles about the protection of personal information, and procedure for collection, use and destruction of information. Bioethics and Safety Act (Amended by No. 11250) are applied to the "Human Subject Research", which includes research using personal information. Reviewing the implications of such Acts, it could be found that informed consent, audit from institutional review board(IRB) and anonymization are important measures for patient privacy and protection of personal information.
